1. النطاق والقبول
تنظم هذه الشروط الوصول إلى خدمات Hawares الرقمية واستخدامها، بما في ذلك NASQ OPS والبوابات ولوحات التحكم وواجهات الربط والتجارب وخصائص الاشتراك.
يُعد إنشاء الحساب أو بدء التجربة أو شراء الاشتراك أو الاستمرار في استخدام الخدمة بعد إشعار التحديث قبولًا للمستندات القانونية المعمول بها.
1. Scope and acceptance
These Terms govern access to and use of Hawares digital services, including NASQ OPS, related portals, dashboards, APIs, trials and subscription features.
Creating an account, starting a trial, purchasing a subscription, or continuing to use the service after notice of an updated version constitutes acceptance of the applicable legal documents.
2. الحسابات والاستخدام المصرح
يتحمل العميل مسؤولية صحة معلومات الحساب وحماية بيانات الدخول وتعيين الأدوار المناسبة وضمان التزام المستخدمين بالصلاحيات الممنوحة.
لا يجوز استخدام الخدمة بما يخالف الأنظمة أو يهدد الأمن أو التوافر أو يتضمن برمجيات ضارة أو وصولًا غير مصرح به أو معالجة بيانات لا يملك العميل أساسًا مشروعًا لمعالجتها.
2. Accounts and authorized use
The customer is responsible for accurate account information, safeguarding credentials, assigning appropriate roles, and ensuring that users act within granted permissions.
The service may not be used to violate applicable law, compromise security or availability, introduce malicious code, attempt unauthorized access, or process data the customer has no lawful right to process.
3. الاشتراك والرسوم والضرائب
تُحدد المزايا وحدود المستخدمين والأسعار ودورات الفوترة وفق الخطة أو سجل الشراء أو الطلب أو شاشة الاشتراك المعمول بها وقت الشراء.
تكون الرسوم غير شاملة للضرائب ما لم يُنص صراحة على خلاف ذلك، وتتم معالجة الضرائب والرسوم الحكومية وفق الأنظمة المعمول بها.
3. Subscription, fees and taxes
Features, user limits, pricing and billing periods are defined by the plan, checkout record, order or subscription screen applicable at the time of purchase.
Fees are exclusive of taxes unless expressly stated otherwise. Applicable taxes and governmental charges are handled in accordance with applicable law.
4. بيانات العميل
يحتفظ العميل بحقوقه في البيانات والسجلات والمستندات والمرفقات والإعدادات والمحتوى الذي يقدمه إلى الخدمة.
يجوز لـ Hawares معالجة بيانات العميل بالقدر اللازم بصورة معقولة لتقديم الخدمة وتأمينها ودعمها وصيانتها ونسخها احتياطيًا وإدارتها والامتثال للالتزامات النظامية.
4. Customer data
The customer retains its rights in data, records, documents, attachments, configurations and content submitted to the service.
Hawares may process customer data only as reasonably necessary to provide, secure, support, maintain, back up and administer the service and to comply with applicable legal obligations.
5. التوافر والصيانة
يجوز لـ Hawares تنفيذ صيانة مجدولة أو طارئة وتعديل الخدمة لتحسين الأمن أو الاعتمادية أو الوظائف أو الامتثال النظامي.
لا يُعد التشغيل المتواصل دون انقطاع أو أخطاء التزامًا تعاقديًا ما لم تنص اتفاقية مستوى خدمة مستقلة وموقعة على خلاف ذلك.
5. Availability and maintenance
Hawares may perform scheduled or emergency maintenance and may modify the service to improve security, reliability, functionality or legal compliance.
No uninterrupted or error-free operation is promised unless a separately signed service level agreement expressly provides otherwise.
6. الملكية الفكرية
تحتفظ Hawares والجهات المرخصة لها بحقوق البرمجيات والواجهات وسير العمل والتصاميم والوثائق والعلامات وتقنيات الخدمة، باستثناء بيانات العميل.
يحصل العميل على حق محدود وغير حصري وغير قابل للتحويل لاستخدام الخدمة خلال الاشتراك النشط لأغراض أعماله الداخلية.
6. Intellectual property
Hawares and its licensors retain rights in the software, interfaces, workflows, designs, documentation, trademarks and service technology, excluding customer data.
The customer receives a limited, non-exclusive, non-transferable right to use the service during an active subscription for internal business purposes.
7. الإطار النظامي
صيغت هذه الشروط للعمل ضمن الأنظمة واللوائح المنطبقة في المملكة العربية السعودية، مع مراعاة القواعد الإلزامية التي قد تسري على العميل أو المعاملة.
تظل المعاملات والسجلات والتجارة الإلكترونية خاضعة للأنظمة واللوائح السعودية المنطبقة.
7. Governing framework
These Terms are intended to operate within the laws and regulations applicable in the Kingdom of Saudi Arabia, subject to mandatory rules that may apply to the customer or transaction.
Electronic contracting, records and commerce remain subject to applicable Saudi laws and regulations.
